1. Scope of Application
These Terms and Conditions of Use govern the relationship between you, the user, and Langdon, Schönleinstraße 23, 10967 Berlin, privacy@langdon.guide (hereinafter: Langdon) as the service provider.
All agreements between you and Langdon arise, in particular, from these Terms and Conditions of Use. Unless expressly agreed otherwise, the inclusion of any terms you may use yourself is hereby rejected.
2. Subject Matter of the Agreement
The subject of this agreement is your use of, and access to, the museum app. The app currently provides information about the British Museum.
Access to the background information is provided by Langdon, which independently supplies AI-generated content via the relevant application programming interfaces (APIs) of large language models, such as ChatGPT, in accordance with the applicable terms of use of the language-model providers.
No warranty is given for the accuracy of the AI-generated content.
Use of Langdon is permitted only for holders of a user account established on the basis of a contract concluded with a customer of Langdon. A user account may be created by the user or by Langdon. Activation of a user account requires the user’s acceptance of these Terms and Conditions of Use.
3. Registration and Right of Use
By submitting the registration form within the app, the user makes an offer to conclude a user agreement. Registration is free of charge unless the user is informed of a fee before registering.
The user agreement is formed when Langdon confirms the registration.
All natural persons aged 18 years or older are eligible to register.
Creating user profiles includes the right to use the data contained in the app (hereinafter: profile data). This right comprises viewing, analyzing, and exporting the data for further processing. Profile data may be used solely for the user’s own purposes and may not be disclosed to third parties.
Users acquire no usage or other rights to the content provided in the app.
4. User Obligations
When using the customer account and its offerings, the user must act with due care and take into account the particular risks associated with the internet. In particular, the following duties of care apply:
Logging out of the customer account after each session;
Keeping the customer-account password confidential and protecting it from unauthorized access by third parties; and
Independently updating the data stored in the customer account.
The user shall not use the customer account in breach of these Terms and Conditions of Use of Langdon, in particular not to create fake accounts (especially to mislead about the user’s identity) or to create one or more customer accounts after a user’s account has been suspended or deactivated.
5. Fees and Availability
Use of Langdon is free of charge for users. Langdon reserves the right to introduce paid features in the future. In such case, Langdon will inform users in good time.
The availability of Langdon may be limited by restrictions of the hosting provider, maintenance windows, or other technical requirements. Langdon cannot guarantee, and the user cannot demand, uninterrupted access.
6. Liability
Langdon accepts no liability for the use of background information obtained from Langdon. Nor is Langdon liable for the output of the respective language models or for data processing related thereto.
7. Amendments to the Terms and Conditions of Use
Langdon reserves the right to amend these Terms and Conditions of Use where compelling legal and/or economic reasons prevail after balancing both parties’ interests—for example, significant technical developments, changes in the law or case-law, or other equivalent reasons.
The amended Terms and Conditions of Use will be sent to registered users by e-mail two weeks before they take effect. If a user objects to the amendments before they take effect, the user agreement will end upon the new Terms and Conditions entering into force. Langdon will point out this legal consequence when sending the amended Terms. If the user does not object within that period, or within any different period stated in the notice, continued use of the customer account is deemed acceptance of the amendments.
8. Final Provisions
If the user is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is the registered office of Langdon.
German law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
